(AMS) brought suit in the United States District Court for the Eastern District of Wisconsin against Medical Engineering Corporation (MEC) for willful infringement of United States Patent No. 4,597,765, issued to Klatt (the 765 patent). MEC counterclaimed for declaratory judgment of invalidity and noninfringement, for an alleged breach of warranty, and for intentional, negligent and fraudulent misrepresentation by AMS.
